TERMS
Effective date: 23 July 2025

When scheduling an appointment with AmraXismet, it is expected that you will be present and on time.
Our time is as valuable as yours.
A missed appointment, without notice within 72 hours, will be charged.
Article 1 - Project Appointment
If a cancellation is made less than 24 hours before the scheduled appointment, a fee equal to 75% of the reserved service cost will be charged.
When making an appointment, a deadline is always discussed. This deadline ensures that both parties adhere to the appointment. If the customer does not adhere to the appointment, the project will be considered complete and officially closed.
Article 2 - Changes and Risks
During the appointment, changes may occur, such as (Scripts or Plans).
If an artist or client changes their mind during the agreed plan, situation, or payments, this can lead to an unfortunate risk.
AmraXismet may choose to stop the project. Therefore, AmraXismet discusses everything in advance with the client/label or artist to prevent risks, disputes, or misunderstandings.
Non-included AmraXismet equipment or media material is at the client's/label's and/or artist's own risk. Avoid quality differences in your script/media material or scheduled appointment.
Article 2-A - Liability and Damage During a Project
AmraXismet is not responsible for any accidents involving third parties during an ongoing project or at one of the rented project locations. By requesting our services, you automatically agree to our general terms and conditions, which limit liability. According to the law, you are responsible for compensating any damages if you fail to comply with an agreement. A too broad or complete exclusion of liability may be considered unreasonable by the court, which may require you to pay the full compensation. Therefore, we advise not to bring third parties or uninvited guests to the set, as you will bear the risk of liability.
Article 3 - Coupon & Voucher Conditions
Some of our Coupons/Voucher are subject to travel surcharges.
If you choose a service that requires us to travel,
the following surcharge applies:
- Video Clip: travel surcharge
- Outdoor Photoshoots: travel surcharge
- Studio Photoshoots: travel surcharge
- Drone Shoots: travel surcharge
- Filming Only: travel surcharge
- Party Video: travel surcharge
- Party Photography: travel surcharge
AmraXismet Coupons/Voucher are always valid for 3 months for the categories mentioned above.
When adding an extra service, you automatically pay for the extra service.
With the 3 for 2 or 4 for 3 promotion, the cheapest service is free.
Coupons/Voucher cannot be combined with other promotions or discounts.
Article 4 - Coupon & Voucher Advantage
AmraXismet offers the customer a one-time advantage stated on the Coupons/Voucher, under the conditions mentioned. This advantage can be a discount in amount or percentage, or a gift. This applies when requesting one or more services, or when reaching a (minimum) certain amount of services within the indicated categories of AmraXismet.
Unless otherwise stated on the coupon or in the accompanying promotion conditions, the coupon can be redeemed via the form on Amraxismet.com.
Article 5 - Coupon & Voucher Validity
When used on the AmraXismet website, the customer must fill in all required Coupons/Voucher details in the designated fields or upload the pdf file in the Upload button. This must be done according to the website's functionality, where the customer indicates which Services they wish to apply the Coupons/Voucher benefit to.
The discount obtained with the coupon is deducted from the total amount of the service at the time of full payment. In the case of a deposit, the customer does not receive a partial benefit; the benefit is fully applied upon final settlement of the respective service.
The Coupons/Voucher is valid for the period stated on the coupon.
The Coupons/Voucher can only be used once.
The Coupons/Voucher must be used in one go, any remaining balance will be forfeited.
The Coupons/Voucher cannot be combined with similar benefits or other Coupons/Voucher.
The Coupons/Voucher cannot be exchanged for cash.
Duplicating or distributing the Coupons/Voucher number or other Coupons/Voucher details is prohibited and may result in a €2500 fine for fraud.
When using the Coupons/Voucher in AmraXismet service categories, only original and/or undamaged Coupons/Voucher are valid, any modification makes the Coupons/Voucher invalid.
The customer cannot derive any rights from the inability to use the Coupons/Voucher. The Coupons/Voucher can never be used retroactively. After requesting one or more services, the Coupons/Voucher cannot be applied to that purchase afterward.
Article 6 - Coupon & Voucher Liability
AmraXismet accepts no liability for the loss or theft of the Coupons/Voucher, nor for unauthorized use and/or fraudulent activity with the Coupons/Voucher. Unless there is intent or gross negligence, AmraXismet is not liable for damages resulting from or related to the inability, untimely, incomplete, or conditional use of the Coupons/Voucher, regardless of the reason.
Article 7 - Coupon & Voucher Final Provisions
AmraXismet reserves the right to make changes to these general Coupons/Voucher conditions.
By using the Coupons/Voucher, the customer agrees to these general coupon conditions and the conditions stated on Amraxismet.com/terms.
The general service terms can be found on the AmraXismet website.
If a provision in these general terms is found to be invalid, unenforceable, or illegal, the remaining provisions remain in force.
Dutch law applies to these general Coupons/Voucher terms. Any disputes arising from these general terms will be submitted to the court in the Netherlands or Spain.
Article 8 - Equipment Rental
1.A Deposit and Documentation
When renting from us for the first time, you must email or bring the following two documents when picking up.
- Identification proof
- Documentation.
- Private rental: A recent postal item or digital purchase receipt showing your current address.
- Business rental: A proof of your company. This can be a Chamber of Commerce extract, business card (you show us this). If you used the official company email address when submitting the rental request, this is also sufficient. The documentation can be emailed or shown when picking up.
2.A Deposit
When renting from us for the first time, we may ask for a deposit. The amount of the deposit depends on various factors: whether you are renting for business or personal use, have previously rented from us, the value of the equipment, the rental term, etc. After your request, you will receive information about the deposit for the relevant equipment. You can contact us in advance for a price indication.
3.A Reservations
Reservations can be made by email, online reservation form, or telephone (for regular customers).
In the case of telephone reservations, we ask our customers to confirm the reservation via email or the online reservation form. Verbal reservations are not final unless otherwise agreed. For definitive reservations, we ask for a fee of €50.00 as an advance payment from customers. This can be paid in cash or transferred via bank.
4.A Responsibility
Customers are (jointly) responsible for checking the equipment upon collection before signing the rental agreement. We strive to deliver the equipment to our customers in optimal working condition. Furthermore, customers are responsible for the settings of the equipment. You can find the manuals of our equipment on our website and via search engines.
1.B Insurance Against Damage
Renting without damage insurance: The renter is responsible for all costs if the customer has not taken out damage insurance. The renter bears all costs for repairs of equipment, parts, or accessories. Additionally, we are entitled to recover the rental costs from the renter. This is the period between the date the equipment was supposed to be returned until the handling of the incident. The renter must always inform us about damages/loss of equipment. This will reduce the costs for the renter and speed up the handling process.
In case of theft or loss of equipment, the renter must pay all costs to us within 10 days.
2.B Loss, Theft, Misplacement of Equipment/Parts
In case of loss, theft, or misplacement of equipment, the renter owes us the new value of the product. Another possibility is that the renter and we agree that the renter buys the same brand and type of device/part and transfers it to us.
Damage is defined as follows: Any material and immaterial effect on the camera so that the camera does not function optimally. Examples of damage include cracks, hardware, sound or image defects, or internal damage, etc.
The equipment must be collected by the renter at the landlord's premises/house unless expressly agreed otherwise. If the renter does not pick up the rented equipment at the agreed time at the start of the rental period, they are entirely responsible for their own account and risk.
The rental price is always due for the written agreed rental period.
The equipment must be returned by the renter to the landlord's premises no later than the agreed end date of the rental period unless agreed otherwise in writing. If the renter does not return the rented equipment by the agreed end date, for any reason, as well as in case of damage to the equipment, by any cause, the renter is in default without any reminder or notice of default being required. If the renter, notwithstanding their other obligations due to the landlord, the renter owes the landlord compensation. In case of late return, this compensation amounts to the rental price per day for each day the agreed rental period is exceeded plus 50% of that rental price.
In case of damage to the equipment, the renter owes the cost of repair of that damage (up to a maximum deductible) as compensation as well as the rental price per day for each day the repair takes plus 50% of that rental price.
If the landlord suffers a higher amount of damage due to late return by the renter and/or due to damage to the equipment than the amount of compensation the renter would owe based on the foregoing paragraph of this article, the landlord will have the right to claim this additional amount of compensation from the renter.
3.B Cancellation / Non-Collection of Equipment
Sometimes you need to cancel the rental due to certain circumstances. This is possible, but costs are associated with the reservation and cancellation of the rental, which arise from the costs we incur.
We advise you to consider these costs when canceling.
The earlier you cancel, preferably at least 48 hours before the pick-up date, the lower the costs will be.
For cancellations within 48 hours before the pick-up date, the following costs apply: €30.00 if the rental costs are less than €60.00 incl. VAT, and 50% of the rental costs if the rental costs are higher than €60.00 incl. VAT. If you cancel within 24 hours before the pick-up date, you pay the full rental amount.
We advise you to think carefully before canceling, given the costs involved. If you still need to cancel, we recommend notifying us in writing as soon as possible, so you incur as few costs as possible and we can quickly make the equipment available to other customers.
When canceling, we charge various costs, including administration costs and the rental costs you would pay if the rental went through, as well as the rental costs another customer would pay for the relevant equipment during your reservation period.
Article 9 - Project Duration and Termination (REQ Cases)
9.1 Service-specific durations
AmraXismet applies fixed timeframes for the completion of projects submitted as a REQ Case, depending on the type of service:

For music and video clip projects, the maximum duration is 30 calendar days, starting from the initial project date or the last recorded activity.

For all other services (such as photography, graphic design, content editing, etc.), the maximum duration is 15 calendar days.
9.2 Neglect and consequences
If there is no communication or progress from the client within the applicable timeframe, this will be considered project neglect.
In such cases, AmraXismet reserves the right to:

register and invoice extra working hours;
-
and/or automatically terminate the REQ Case, with no further obligations or costs to the client.
9.3 Inactivity notice
Before a case is closed or additional hours are invoiced, AmraXismet will always send a reminder email to the client. This email will inform the client of the inactivity and request a response or formal closure of the project within 48 hours.
If no response is received within that period, the provisions of Article 9.2 will be enforced.
9.4 Fairness and transparency
This policy ensures clear expectations, mutual respect for time investment, and transparent handling of all projects for both the client and AmraXismet.
Article 10 - General Terms and Conditions for Freelancers at AmraXismet
10.1 Delivery deadlines for all AmraXismet content material

AmraXismet: The client, represented by AmraXismet.com.

Freelancer: The independent contractor performing work for AmraXismet.

Assignment: Any agreed task within the categories Music, Photography, Music Video, Instrumentals, and Digital Content.

Raw Material: Unmodified or unedited material (audio, video, photos, files).
10.2 Delivery deadlines for all AmraXismet content material
The freelancer is required to deliver raw and all other material to AmraXismet in atimely and complete manner after execution of the assignment:

Studio Raw Music Recordings
-
Must be submitted within 3 days after completion of the recording.
-
To be sent to administration or the designated project leader.

Raw Music Video and/or Video Footage
-
Must be submitted within 3 to 5 days, depending on file size and transfer time.

Raw Photos and Image Files
-
Must be submitted within 3 days after completion of the photoshoot.
-

Raw Instrumentals and/or Beats
-
Must be submitted within 3 to 5 days, depending on file size and transfer time.

Raw Edited Production Files and Formats
-
Must be submitted within 3 to 5 days, depending on file size and transfer time.

10.3 Responsibility and quality

The freelancer shall only deliver original work and guarantees that no copyright infringements are made.

The freelancer is responsible for the quality and usability of the delivered files.
-
Damaged or unusable files must be resubmitted at no additional cost.
10.4 Communication and administration
-
All communication must go through the appointed project leader or AmraXismet’s administration.
-
Freelancers must correctly label all files with project name and date.
-
In case of uncertainty or delay, the freelancer must notify AmraXismet within 24 hours.
10.5 Compensation and invoicing

Freelancers will only receive payment after proper and timely delivery of the work.

Any additional work or extra hours must be approved in writing by AmraXismet beforehand.

Invoices must be submitted within 7 days after delivery of the work.
10.6 Confidentiality

All files, projects, and client information must be treated as strictly confidential.

Freelancers are prohibited from using material or information for personal promotion or sharing with third parties without prior consent.
10.7 Intellectual property rights

All rights to the delivered material shall transfer to AmraXismet upon delivery and payment.

The freelancer retains the right to use the work for portfolio purposes only with prior written consent from AmraXismet.
10.8 Sanctions for non-compliance

In case of late or incomplete delivery, AmraXismet may apply a penalty or deduction from the agreed fee.

In case of repeated violations, AmraXismet reserves the right to permanently terminate the collaboration.
10.9 Force majeure

If delivery is not possible due to force majeure (illness, technical failure, etc.), the freelancer must notify AmraXismet immediately.

A new delivery deadline will be set in consultation.
10.10 Final provisions
-
These Terms and Conditions are governed exclusively by Dutch law.

Any disputes shall be submitted to the competent court in Amsterdam Netherlands.

AmraXismet reserves the right to unilaterally amend these Terms and Conditions.
